Dispute Representation
Withheld pension following employer restructuring
Challenge
A client in his late fifties had his private employer pension suspended following a corporate restructuring. The company disputed his entitlement under the scheme's legacy provisions, which had not been reviewed in over fifteen years.
Our Approach
We reviewed the original scheme documents, the restructuring agreement, and the employer's correspondence. Submissions were prepared and correspondence issued. The matter proceeded to mediation rather than formal proceedings.
Outcome
The client's entitlement to a partial pension was recognised, with back payments agreed through the mediation process. Timeline: approximately four months from initial instruction to resolution.
Entitlement Review
Unrecognised entitlements in a legacy government scheme
Challenge
A retired client had worked for a statutory board prior to the expansion of CPF coverage. She was aware she had some form of defined-benefit entitlement but had received no recent correspondence about it and was uncertain what, if anything, remained payable.
Our Approach
We reviewed her employment records, the applicable statutory board pension rules, and identified which provisions remained in force. The advisory letter set out the entitlements in plain terms with guidance on how to make the relevant claim.
Outcome
The client identified and subsequently claimed a surviving spouse provision she had not been aware of, and a modest monthly pension entitlement that had not been initiated at retirement. Timeline: review completed within ten working days of the initial consultation.
Estate & Pension Planning
Coordinating a blended estate with CPF and private accounts
Challenge
A couple in their early sixties had CPF accounts, an existing insurance-linked retirement product, and an older will that had not been updated since their children were minors. They were concerned that the documents did not form a coherent whole.
Our Approach
Three sittings over six weeks, with an interval between the first and second to allow discussion. We identified conflicting beneficiary nominations, addressed the interaction between the will and CPF nominations, and coordinated the update of both the will and LPA.
Outcome
A written estate and pension plan was produced, setting out all arrangements, the rationale for the decisions made, and the steps remaining for execution. Both clients described the result as the clearest their affairs had been in some years.
